All Submissions shall automatically become the sole and exclusive property of TOL Inc./José Eber Hair and shall not be returned to you.

In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant TOL Inc./José Eber Hair the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, comment, or other content. Cancellation Policy

Minimum 24 hours notice of cancellation required. Notification for instance via mail, email, or by phone will be accepted subject to confirmation in writing.

Refund Policy

Both Client and ourselves have the right to terminate any services agreement for any reason, including the ending of services that are underway. If you are dissatisfied with any purchase, we offer a 30-Day Money Back Guarantee on all products we offer. Please contact customer service at joseeberhair@custservdirect.com in advance to obtain an RMA (Return Merchandise Authorization) number within 30 days of purchase date. Return process will be provided when RMA is given. All refunds will be provided as a credit to the credit card used at the time of purchase within five (5) business days, upon receipt of the returned merchandise. We cannot credit shipping charges on returns.

Delivery/Shipping Policy

Please refer to checkout page for cost of shipping on the item selected.

We ship via the most efficient shipping method at the time of the purchase to any location within the continental U.S., Alaska, Puerto Rico, Hawaii, U.S. Virgin Islands, Guam, and other U.S. Territories, except P.O. boxes. Brokerage, customs, or any other fees are the responsibility of the recipient. For International orders and U.S. Military addresses please contact customer service at joseeberhair@custservdirect.com. Credit card authorization and verification must be received prior to processing and shipping. Items generally ship within 2-5 business days from the date of order, from our warehouse in California. Delivery times will vary greatly depending upon where your order is destined, but our experience has shown that most orders are received between 3 and 7 business days after leaving our warehouse in California. An e-mail message will be sent when your order ships. This e-mail will list your order number and UPS tracking number. Please retain this and reference your order number should you need to correspond with us. We currently do not offer expedited shipping services.

International Shipping

Shipping rates do not include duties, taxes, or other non-routine customs brokerage charges. Other shipping charges, surcharges, or value-added service charges may apply.

Canadian Duties and Taxes

 

Any order being shipped to a destination in Canada is subject to import duties and taxes. When placing an order on JoseEberHair.com, you are considered the importer of record and must comply with all applicable laws and regulations. Charges for duties, taxes and the carrier's collection fee are in addition to your shipping charge and must be borne by you. Please contact your local customs office for further information.

 

 

Errors

We attempt to be as accurate as possible and eliminate errors on the Site; however, we do not warrant that any product, service, description, photograph, pricing or other information is accurate, complete, reliable, current or error-free. In the event of an error, whether on the Site, in an order confirmation, in processing an order, delivering a product or service or otherwise, we reserve the right to correct such error and revise your order accordingly if necessary (including charging the correct price) or to cancel the order and refund any amount charged. Your sole remedy in the event of such error is to cancel your order and obtain a refund.

These Terms and Conditions shall be binding on you when entering any competitions operated by Jose Eber Hair, its sponsor, partners or any company or website owned or controlled by Jose Eber Hair.

1. These Terms and Conditions shall be binding on you when entering any competitions operated by Jose Eber Hair, its sponsor, partners or any company or website owned or controlled by Jose Eber Hair.
2. These Terms and Conditions apply to all contest entrants. Jose Eber Hair may amend them from time to time. Special prizes, ways to enter and Terms and Conditions may apply to particular contests, and if so these will be stipulated at www.joseeberhair.com/contests.
3. Each competition will have a specific closing date and this will be stipulated at www.joseeberhair.com/contests.
4. Unless otherwise stipulated, only one entry per person will be allowed, as limited by the email address entered on the competition entry form.
5. All persons entering our contests via email will automatically be added to our email marketing lists. Entrants may at any time choose to opt out of email communications by unsubscribing through an email link found on any emails received from Jose Eber Hair. We will never pass on your email address to a third party unless you specifically opt in to this on the relevant competition entry page at www.joseeberhair.com/contests.
6. Employees of Jose Eber Hair or their family members or anyone else connected in any way with the contest or helping to set up the contest shall not be permitted to enter the contest.
7. There is no entry fee and no purchase necessary to enter any contest operated by the promoter.
8. No responsibility can be accepted for entries not received for whatever reason.
9. You may not enter a contest if, on the date it is announced, you do not conform to the required profile of an entrant. For example a contest may be limited by age or location. Unless otherwise stipulated all contest entrants must be aged 18 or over.
10. The promoter reserves the right to cancel or amend the contest and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the contest will be notified to entrants as soon as possible by the promoter.
11. The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this contest and prizing may change from what is listed in the giveaway details based on availability and inventory.
12. No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
13. Winners will be chosen at random by the Jose Eber Hair marketing department within one week of the closing date of the contest.
14. The winner will be notified by email and/or letter within 14 days of the closing date. If the winner cannot be contacted or does not claim the prize within 7 days of notification or otherwise stated, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
15. The promoter will notify the winner when and where the prize can be collected or is made available or the prize will be shipped to them directly.
16. The promoter’s decision in respect of all matters to do with the contest will be final and no correspondence will be entered into.
17. The contest and these terms and conditions will be governed by US law and any disputes will be subject to the exclusive jurisdiction of the courts of the USA.
18. The winner agrees to the use of his/her name and image for publicity purposes without payment of additional consideration, except where prohibited by law. 
19. Any personal data relating to the winner or any other entrants will be used solely in accordance with current USA data protection legislation and will not be disclosed to a third party without the entrant’s prior consent. You are providing your information to Jose Eber Hair and the information provided will be used in conjunction with the following Privacy Policy found at www.joseeberhair.com/privacy-policy.
20. The winner’s name will be made available 28 days after closing date by sending a stamped addressed envelope to the address stipulated in sentence 1. Above.
21. The person entering the contest releases Jose Eber Hair and any of their group companies and the officers, directors, employees, shareholders or agents of any of them, from all liability and responsibility for any loss or damage that may result to them or a third party (including without limitation, any direct, indirect or consequential loss or damages and whether in tort (including without limitation negligence), contract or otherwise) in connection with the contest.
22. The entrant must take all reasonable steps to ensure his/ her own health and safety. All activities are undertaken at the entrant’s own risk. The entrant must notify Jose Eber Hair of any medical and or other condition which may mean that he/ she is unfit for participation as soon as he/ she becomes aware of such a condition.
23. By entering this competition, an entrant is indicating his/ her agreement to be bound by these terms and conditions.
